Kommunale Vertreter in der D&O-Versicherung<\/strong><\/strong><\/strong><\/h2>\n\n\n\n

Kommunale Tochterunternehmen und dort t\u00e4tige Vertreter der Gemeinde (meist: Aufsichtsr\u00e4te) stellen die D&O-Versicherung vor besondere Herausforderungen. Denn im Fall der Inanspruchnahme eines Gemeindevertreters stehen diesem neben dem Deckungsanspruch aus der D&O-Versicherung gegen\u00fcber der ihn entsendenden Kommune \u00f6ffentlich-rechtliche Freistellungsanspr\u00fcche zu, die mit Zahlung des Versicherers auf diesen \u00fcbergehen (\u00a7 86 VVG). Zum Teil versuchen D&O-Versicherer, auf Grundlage dieser Anspr\u00fcche nach erbrachter Versicherungsleistung bei der Kommune Regress zu nehmen (vgl. VG M\u00fcnchen v. 28.05.2019, Az. M 5 K 17.1499).<\/p>\n\n\n\n

In der aktuellen Ausgabe der Zeitschrift “Versicherungsrecht” (VersR 2021, 1206 ff.) greift Dr. Marius Mehring, LL.M.<\/a><\/strong> diese Entwicklung auf und erl\u00e4utert, warum solche Regressversuche von D&O-Versicherern gegen Kommunen keine Aussicht auf Erfolg haben. Er befasst sich au\u00dferdem damit, wie sich  Rechtsstreitigkeiten durch eine vorausschauende Gestaltung der Versicherungsbedingungen von vorneherein vermeiden lassen.<\/p>\n<\/div>\n\n\n\n
